KFCRI Arbitration Research: Briefing an International Arbitrator

Kavya joined KFCRI ADR Institution supporting an international arbitrator handling a cross-border case in China. The arbitrator needed research support to prepare for proceedings, and Kavya was responsible for turning the raw case material into something usable.

The source material ran to several hundred pages. Her task was to read through it, extract the facts, identify the core issues, and produce a structured output without making assumptions or introducing inference beyond what the documents supported.

She organized her output around three layers: the facts as established by the documents, the issues the case was trying to resolve, and the applicable legal framework that governed the matter. This structure became both a ten-page written brief and a presentation deck for the wider team.

The brief gave the arbitrator a clear, fact-grounded summary he could work from directly. The presentation made the same material accessible to others on the team who needed to understand the case without reading the full file.

The discipline she applied was to stay strictly within the evidence, presenting what the documents showed rather than what she thought the outcome should be.
